DODGE CITY CAMPGROUND LLC LONDON, KENTUCKY GENERAL LIABILITY WAIVER, RELEASE OF CLAIMS & ASSUMPTION OF RISK PLEASE READ CAREFULLY BEFORE SIGNING.
This document affects legal rights and applies to RV sites, tent camping, cabin rentals, camper rentals, fishing, playground/common areas, campground roads and trails, and other permitted activities. This waiver applies to each adult who signs below and, to the extent permitted by law, to minor children listed below for whom a signing adult is legally authorized to sign.
1. PARTICIPANT / GUEST ACKNOWLEDGMENT I understand that camping, lodging, fishing, recreation, and use of campground property involve inherent and other risks, both known and unknown. I voluntarily choose to enter, stay at, visit, or participate at Dodge City Campground LLC and accept responsibility for my own safety and for the supervision of any minor child for whom I am legally responsible. Each adult in the party who signs this waiver makes this acknowledgment individually.
2. ASSUMPTION OF RISK Risks may include uneven, wet, muddy, icy, steep, or obstructed ground; slips, trips and falls; roads, parking areas and moving vehicles; RVs, campers and camping equipment; electrical, water and sewer hookups; campfires, grills and hot surfaces; cuts, burns and falling objects; trees and falling limbs; storms, lightning, wind, flooding, heat, cold and other weather; insects, snakes, wildlife and vegetation; playground equipment; buildings, porches, decks, stairs, furniture, appliances and utilities; fishing hooks, lines and equipment; pond banks, deep water and drowning hazards; and acts or omissions of other guests. These risks may result in property damage, illness, bodily injury, permanent disability, drowning, or death. Each signing adult knowingly and voluntarily assumes these risks to the fullest extent permitted by law.
3. RV SITES AND TENT CAMPING Each signing adult accepts responsibility for safely setting up, using and securing their RV, camper, tent, awning, cords, hoses, equipment and personal property, and agrees to use campground utilities and facilities only for their intended purposes and promptly report unsafe conditions observed.
4. CABIN AND CAMPER RENTALS - ASSUMPTION OF RISK Each signing adult knowingly and voluntarily assumes all risks associated with the use, occupancy, and enjoyment of rental cabins and rental campers, including known and unknown risks associated with steps, porches, decks, doors, floors, furniture, beds, appliances, plumbing, electrical systems, heating or cooling equipment, fixtures, fire, burns, slips, trips, falls, falling objects, weather, insects, wildlife, and other indoor or outdoor rental conditions. Such risks may result in property damage, illness, bodily injury, serious or permanent injury, disability, or death. Each signing adult agrees to use the rental responsibly, promptly report unsafe conditions, and understands they may be financially responsible for damage caused by them, their children, pets, visitors, or members of their party beyond ordinary wear and tear, subject to applicable rental terms.
5. FISHING POND & WATER SAFETY - ASSUMPTION OF RISK Each signing adult understands that fishing and being near the pond involve inherent and other risks, both known and unknown, including slips and falls; steep, uneven, muddy, wet, or unstable pond banks; falling into the water; deep water; drowning; fishing hooks and lures; cuts or puncture wounds; fishing lines and equipment; insects; snakes; wildlife; weather; and actions of other persons. Each signing adult knowingly and voluntarily assumes all such risks, including risks of property damage, illness, bodily injury, serious or permanent injury, disability, drowning, or death, to the fullest extent permitted by law. NO SWIMMING IS PERMITTED. Fishing is catch and release only, and no treble or double hooks are permitted. Children must be appropriately supervised by a responsible adult at all times while fishing or near the pond. A signing parent or legal guardian accepts responsibility for that supervision and, to the extent permitted by applicable law, acknowledges and accepts the described risks for any minor listed below for whom that adult is legally authorized to sign.
6. MINORS AND SUPERVISION All minor children in the party who are intended to be covered by this waiver must be listed on page 2 and appropriately supervised by a responsible adult. A person signing for a minor represents that they are the minor's parent or legal guardian, or otherwise has legal authority to sign. Any release or assumption of risk affecting a minor applies only to the extent permitted by applicable law.
7. PETS Each signing adult accepts responsibility for any pet they bring onto the property. Pets must be kept under control and on a leash as required by campground rules, waste must be cleaned up, and pets are not permitted in the playground area. The responsible guest is liable for injury, damage, or loss caused by their pet to the extent provided by law and campground policies.
8. ATV RIDING, VEHICLES AND CAMPGROUND ROADS - ASSUMPTION OF RISK Operating, riding, mounting, dismounting, or being a passenger on an ATV or other permitted recreational vehicle is inherently hazardous. Risks include collision, rollover, loss of control, falls, ejection, mechanical failure, terrain conditions, obstacles, other vehicles or riders, weather, and acts or omissions of other persons. Each signing adult knowingly and voluntarily assumes all known and unknown risks associated with ATV riding and use on campground property, including risks of property damage, bodily injury, serious or permanent injury, disability, paralysis, or death, to the fullest extent permitted by law. Anyone riding an ATV must comply with campground rules and any separately required waiver. Minor riders require appropriate adult authorization and supervision. All vehicles must be operated carefully, at posted speeds, and only in permitted areas.
9. CAMPGROUND CONDUCT AND RULES Each signing adult agrees to follow posted rules and reasonable instructions from campground management. Violent, threatening, dangerously intoxicated, or seriously disruptive conduct that threatens safety or substantially interferes with other guests may result in removal without refund, subject to applicable law and campground policies.
10. RELEASE AND WAIVER OF CLAIMS To the fullest extent permitted by applicable law, each adult who signs below individually releases and waives claims against Dodge City Campground LLC and its owners, members, managers, operators, employees, volunteers, agents, representatives, contractors and affiliated persons or entities for personal injury, death, property damage, or other loss arising from the ordinary risks of that person's presence or participation, including claims based on ordinary negligence, except to the extent a release is prohibited or unenforceable under applicable law. Nothing in this waiver is intended to release conduct that cannot legally be released.
11. PERSONAL PROPERTY AND EMERGENCY CARE Each signing adult is responsible for safeguarding their vehicles, RV, camper, camping equipment, fishing equipment and other personal property. If an emergency occurs and a signing adult is unable to consent, that adult authorizes reasonable emergency assistance for themselves and, if legally authorized, for a minor listed below. Dodge City Campground LLC does not guarantee medical care, and applicable medical expenses remain the responsibility of the guest except as otherwise required by law.
12. AGREEMENT, PARTY ACKNOWLEDGMENT AND SEVERABILITY Each adult signing below certifies that they have personally had the opportunity to read this entire two-page waiver, understand it, have had the opportunity to ask questions, and voluntarily agree to it. No adult signs on behalf of another adult. Each signature applies to that signing adult and, only to the extent permitted by law, to minor children listed below for whom that adult is legally authorized to sign. If any provision is found invalid or unenforceable, the remaining provisions are intended to remain effective to the fullest extent permitted by law. This waiver does not replace separate reservation, rental, payment, campground-rule, or damage agreements.
